It is being widely reported now that eBay, the Internet's "largest marketplace" is not taking too keen a view of selling pre-loaded iPods on its website. The company recently removed a listing for an Apple iPod loaded with over 11,000 songs, claiming copyright laws.

Cincinnati pediatrician Steve Brin, the person auctioning the device with a starting bid of $799 couldn't comprehend why he could not sell the iPod. Over the years, he claims to have spent an estimated $100,000 to buy the CDs he later ripped to his iPod, and thought it perfectly legal to auction off the iPod on eBay.

eBay, though didn't agree with that and yanked the item off.

"That is a copyright violation, one that we don't even need to hear from the rights owner about before removing," said eBay spokesman Hani Durzy, also referring to eBay's Replica and Counterfeit Items policy.

What do you guys think? Should he be allowed to sell his iPod without having someone claim copyright infringement? Or is it really illegal?

I'm not trying to be rude here, but are you people really that stupid? It's no wonder the RIAA is suing the crap out of everyone if it's 'common knowledge' that it's okay to rip CDs and then sell the MP3s you just made (or even give them away). If you want to sell an iPod pre-loaded with music, YOU HAVE TO SELL THE CDS YOU RIPPED WITH IT, or it's copyright infringement...

Obviously the iPod part of qj.net is not run by the same people that run psp.qj.net. What this guy is doing with the iPod would be the same as if I tried to sell a PSP with .ISO images of game pre-loaded on the memory stick (of games that I own the UMD of). If _I_ own the UMD, _I_ can make a copy of it, but I _CAN NOT_ sell or give away that copy unless I sell/give away the UMD with it.

You _CAN NOT_ sell or give away MP3s you ripped from a CD unless you sell/give away the CDs _WITH THE MP3S_ at the same time.

If you buy a CD, rip it to your iPod, and then sell the CD at a used CD store, you have broken the law. If you honestly don't think you doing anything wrong, send your name and address to the RIAA, I'm sure they'd just LOVE to explain it to you (in court).

(The above applies to people in the U.S. ripping commercially bought CDs...)

Hey idiot, what if all of the songs were bought from iTunes? I know you are technicaly supposed to erase them from your PC's HDD. People like you who act like they are so innocent and never do anything wrong are full of more BS than anyone.

When you buy a song you dont buy the song you buy the rights to listen to it. When you buy an ipod you dont buy the ipod you buy the right to use it. This is how everything has been sold. If they wanted to Apple could make a firmware that totally renders them into paper wieghts and customers couldnt do **** about it. its their product they can do whatever they want with it. You only have a license to use the ipod hardware under the terms of agreement. You automatically agree to the terms the moment you turn on the ipod.
